Terms of Service

These terms govern your use of the website at www.deadstick.net and every software product published by DeadStick Digital LLC. Please read them carefully.

1. Agreement to these terms

By downloading, installing, or using any software published by DeadStick Digital LLC ("DeadStick", "we", "us"), or by using the website at www.deadstick.net, you agree to be bound by these Terms of Service (the "Terms"). If you do not agree, do not use our software or our website.

2. License to use our software

Subject to these Terms, DeadStick grants you a limited, non-exclusive, non-transferable, revocable license to install and use our applications on devices that you own or control, for your personal or internal business purposes. All rights not expressly granted to you are reserved by DeadStick.

Where an application is distributed through the Apple App Store, your use is additionally governed by Apple's Licensed Application End User License Agreement (EULA), which is incorporated by reference. In the event of a conflict, the stricter provision controls. The EULA is available at apple.com/legal/internet-services/itunes/dev/stdeula.

3. Permitted use & restrictions

You agree that you will not, and will not permit any third party to:

  • Reverse engineer, decompile, or disassemble any portion of the software except to the extent expressly permitted by applicable law;
  • Modify, adapt, translate, or create derivative works based on the software;
  • Remove or alter any proprietary notices or labels;
  • Rent, lease, lend, sell, sublicense, or transfer the software to a third party;
  • Use the software to build a competing product;
  • Use the software in violation of any applicable law, including export controls and sanctions regulations.

4. Purchases & refunds

Paid apps and in-app purchases are sold through the Apple App Store or Google Play. Those platforms handle billing, refunds, and receipts under their own policies. If you believe you are entitled to a refund, please contact the platform first. If you need additional help, we are happy to assist — send a note through the contact form on our website.

5. Your content

Our apps let you create, import, and store content — invoices, receipts, clients, datasets, model checkpoints, network configurations, and so on ("Your Content"). Your Content is yours. DeadStick does not claim ownership of Your Content and does not receive a copy of it. You are solely responsible for Your Content, including ensuring you have the right to use it and that it does not infringe any third party's rights.

6. Availability & updates

We strive to keep our apps working, but we do not guarantee uninterrupted availability, particularly for features that depend on third-party services. From time to time we may release updates, change features, or discontinue features. We will not take a feature you have paid for and lock it behind a new paywall without a reasonable transition path.

7. Third-party services

Some features of our apps connect to third-party services (for example, Hugging Face for datasets, Apple iCloud or Google Drive for sync, your mobile carrier for network access). Your use of those services is governed by the respective provider's terms and privacy policy, not ours. DeadStick is not responsible for the acts or omissions of those third parties.

8. Disclaimer of warranties

Our software and website are provided "AS IS" and "AS AVAILABLE", without warranties of any kind, whether express or implied. To the maximum extent permitted by law, DeadStick disclaims all warranties, including the implied warranties of merchantability, fitness for a particular purpose, non-infringement, and quiet enjoyment. We do not warrant that the software will be error-free, secure, or meet your specific requirements.

9. Limitation of liability

To the maximum extent permitted by law, DeadStick Digital LLC and its officers, members, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or other intangible losses, arising from or relating to your use of our software or website. Our total aggregate liability arising out of or in connection with these Terms will not exceed the greater of (a) the amount you paid DeadStick for the software in the twelve (12) months preceding the claim, or (b) fifty U.S. dollars (US $50).

Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable law — for example, liability for death or personal injury caused by negligence, or for fraud.

10. Indemnification

You agree to indemnify and hold harmless DeadStick, its officers, members, and contractors from any claim, loss, liability, or expense (including reasonable attorneys' fees) arising out of your violation of these Terms, your use of the software, or Your Content.

11. Termination

You may stop using our software at any time. We may suspend or terminate your license if you materially breach these Terms. Upon termination, the license granted in Section 2 ends, and you must uninstall the software. Sections 5 through 13 survive termination.

12. Governing law & disputes

These Terms are governed by the laws of the State of Wyoming, USA, without regard to its conflict-of-laws rules. Any dispute arising under these Terms will be resolved in the state or federal courts located in Natrona County, Wyoming, and you consent to the exclusive jurisdiction of those courts, except where your local consumer-protection law grants you a different forum.

13. Changes to these terms

We may update these Terms from time to time. If a change is material, we will update the "Last updated" date at the top of this page and, where appropriate, notify you in-app or by email. Continued use of the software after the effective date means you accept the revised Terms.

14. App-specific terms

The following sections apply in addition to the general Terms above, only to the app named. Where an app-specific term conflicts with a general term, the app-specific term controls for that app.

14.1 ClawMelt

ClawMelt is a training and inference platform that runs entirely on your own computer. Any base models, datasets, fine-tunes, or derivative weights you load are governed by their own licenses — including open-source licenses (for example, Llama Community License, Apache 2.0, MIT, Mistral Research License) and, where applicable, the commercial terms of the model provider. You are solely responsible for reviewing and complying with those licenses before training, distributing, or deploying a model in production.

ClawMelt does not transmit your training data, prompts, checkpoints, or generated outputs to DeadStick Digital. Because everything stays on your machine, DeadStick Digital has no ability to moderate, filter, or intervene in the content you choose to train on or generate. You agree not to use ClawMelt to train, fine-tune, or serve a model for any purpose that is unlawful, that infringes the rights of others, or that is prohibited by the license of the base model you started from.

14.2 BillingBird

BillingBird is an invoicing and receipt tool for small businesses and freelancers. It is a record-keeping app — it is not an accounting system of record, a tax-filing service, or financial, legal, or tax advice. You remain responsible for the accuracy of the invoices, receipts, client records, and totals you create with it, and for meeting your own jurisdiction's tax, invoicing, and record-retention obligations.

When you enable optional cloud sync (Apple iCloud or Google Drive), your BillingBird data is stored in your own cloud account under that provider's terms and privacy policy. DeadStick Digital has no server-side copy of your BillingBird database and cannot recover it for you if your device and cloud backups are both lost.

14.3 CarrierPigeonVPN

CarrierPigeonVPN establishes a peer-to-peer WireGuard tunnel between your receiving device (Mac, PC, or Apple TV) and your own paired phone. It is not a commercial VPN service: DeadStick Digital does not operate exit nodes, does not anonymize you on the public internet, and does not see the contents, destinations, or metadata of your traffic. Your exit point is your own phone on your own cellular or Wi-Fi plan.

Your carrier's terms govern you, not us. Many mobile carriers place conditions on how data from your phone may be used by other devices — for example, specific rules for tethering, hotspot, or routed traffic, and fair-use or speed caps on unlimited plans. You agree that it is your responsibility to review your carrier's terms of service and acceptable-use policy and to only use CarrierPigeonVPN in a manner those terms permit. DeadStick Digital makes no representation that using CarrierPigeonVPN is compliant with any particular carrier's plan, and is not responsible for any throttling, surcharge, termination, or other action a carrier takes in response to your use.

Acceptable use. You agree not to use CarrierPigeonVPN to perform or enable activity that is unlawful in your jurisdiction or the jurisdiction of the exit point, including — without limitation — sending unsolicited bulk traffic, circumventing access-control systems that are not yours, targeting systems with denial-of-service traffic, or transmitting malware.

As required by Apple's App Store Review Guideline 5.4 and Google Play's VpnService policy, DeadStick Digital will not sell, use, or disclose to third parties any data collected by CarrierPigeonVPN for any purpose, and will not use the VPN tunnel to manipulate ads or track users for advertising, marketing, or analytics purposes.

14.4 Pitot

Pitot is a document scanning, long-term storage, OCR, search, translation, and PDF export tool. It is designed to help you capture and organize important records such as passports, driver's licenses, IDs, forms, and other documents, but it is not a legal records-retention service, regulated document custodian, tax filing service, or substitute for professional advice. You remain responsible for keeping any original documents, backups, or legally required records that your situation requires.

Pitot stores documents locally by default. If a later version offers optional private sync through iCloud or Google Drive, your documents will be stored in your own cloud account under that provider's terms and privacy policy. DeadStick Digital does not operate a proprietary Pitot server that can recover your document vault if your device and backups are lost.
